CONDITIONS FOR FITNESS CENTER (GYM) OPERATIONS 

Article 3 of Circular No. 10/2018/TT-BVHTTDL includes:

 

Facilities and training equipment

Training venues

a) The training room must have a minimum area of 60m2, with a floor-to-ceiling height of at least 2.8 meters; the training space must ensure proper ventilation. The distance between training equipment must range from 10 cm to 30 cm;

b) Lighting must be maintained at 150 lux or above;

c) The sound system must be in good working condition;

d) Restrooms, changing rooms, and personal locker areas for practitioners must be provided; first-aid kits must be available in accordance with the regulations of the Ministry of Health;

e) Internal regulations must include the following primary contents: training hours, eligible participants, individuals restricted from training, and safety measures during training.

Training equipment must comply with the provisions set forth in Appendix 1 issued attached to this Circular.

STATUTORY CONDITIONS FOR SPORTS PROFESSIONAL PERSONNEL 

 

Article 13 of Decree No. 36/2019/NĐ-CP on sports professional personnel of enterprises stipulates as follows:

Professional personnel of an enterprise conducting sports operations shall include:

• Sports training instructors must satisfy one of the following conditions: a) Being a coach or an athlete with a grading of Class 2 or higher, or equivalent, appropriate to the registered sports operations of the business; b) Holding a degree in physical education and sports of intermediate level or higher, appropriate to the registered sports operations of the business; c) Having completed sports professional training in accordance with the regulations of the Minister of Culture, Sports and Tourism.
• Lifeguards.
• Medical personnel.

Article 15 of Decree No. 36/2019/NĐ-CP on the compulsory engagement of training instructors for enterprises conducting sports operations:

PROCEDURES AND APPLICATION DOSSIER FOR FITNESS CENTER BUSINESS LICENSING

 

Enterprises shall submit their dossier via postal services, through the online environment, or directly to the Specialized Sports Authority under the Provincial People’s Committee where the sports business location is registered, or where the enterprise’s headquarters is located in case the enterprise operates multiple sports business locations.

In the event that the dossier requires amendments or supplements, the licensing authority shall notify the enterprise directly or in writing of the necessary amendments or supplements within 03 working days from the date of receipt of the dossier.

The application dossier components shall include:

• An application form for the Issuance of the Certificate of Eligibility for Sports Operations (under Form No. 02, Appendix III of Decree No. 31/2024/NĐ-CP dated March 15, 2024).
• A summary report on the preparations of business conditions for sports operations under Form No. 03 issued attached to Decree No. 36/2019/NĐ-CP dated April 29, 2019, detailing a number of articles of the Law on Amendments and Supplements to a Number of Articles of the Law on Physical Training and Sports.
• The Business Registration Certificate.
